1. Subject of the contract:

1.1. This contract establishes the rights and obligations between the Administration of the site LLC "Виробничі Системи Торнадо" (hereinafter - “Site Owner”) and its Users.

1.2. The current version of the contract is posted on the internet resource https://svitiny.com.ua/ and may be changed at any time by the Administration (site owner).

1.3. The amended version of the contract (Agreement) comes into effect from the moment it is posted on the site.

1.4. The User must independently familiarize themselves with all the conditions for posting and using information on the internet resource during their visit.

2. The following terms and concepts are used in the Agreement:

Site Visitor — a person who visits the site https://svitiny.com.ua/ without the intention of placing an Order or using other services offered on the site;

User — an individual who visits the site to gain access to the site's services, including submitting a request for clarifying information or a commercial proposal. By visiting the site and leaving their personal data, the User accepts the rules and conditions of this Privacy Policy;

Site Owner — LLC «Виробничі Системи Торнадо», which is the author of all house designs presented on the site https://svitiny.com.ua/;

Site — https://svitiny.com.ua/;

Site Administration — employees of LLC «Виробничі Системи Торнадо» who are authorized to manage the site. The Site Administration acts on behalf of the site owner, organizing and processing personal data, determining the composition of data, the purpose of collecting personal information to be processed, and also determining the operations carried out with the data;

Request — a duly executed (by filling out the feedback form) request from the User that contains voluntarily provided personal data of the User for further communication with the Administration and other voluntarily filled out information;

Rules for Using the Site – a document that defines the activities of the Site and regulates its changes or additions. Together with the Privacy Policy, they constitute an Agreement between the User and the Site.

3. Services of the Site and the conditions for their provision

3.1. The Agreement regulates the procedure and conditions for the use of the Site and its functionality by the User. The subject of the contract also includes the responsibilities and obligations of the parties (User and Site).

3.2. The use of the Site by the User means their consent with the Rules and provisions of these Rules for using the site.

3.3. If the User disagrees with the terms of these Rules, they must leave the Site.

3.4. These Rules for using the site apply only to the site https://svitiny.com.ua/. When the User clicks on links available on https://svitiny.com.ua/ to other websites, LLC «Виробничі Системи Торнадо» does not control the actions of third parties and is not responsible for the operations they carry out with the User's personal data.

3.5. The Site Administration does not verify the accuracy of the personal data provided by the User of the Site.

4. Use of the web resource:

4.1. The fact of providing information by the User in feedback forms on the site indicates their consent to its processing by the Site Administration.

4.2. The User is obligated to use this site in accordance with all the rules of this Agreement and applicable law.

4.3. Users and visitors of the Site are prohibited from taking actions with the aim of obtaining, using and/or transferring to third parties the personal data of other visitors or users of the site. 

4.4. The information posted on the site is intended to inform visitors and users about the commercial activities of the Site Owner, current commercial offers, etc. in the volumes and forms determined by the Site Administration. 

4.5. The User has the right to use the information from the site for non-commercial purposes in accordance with the Conditions specified in this Agreement. 

4.6. The User has the right to notify the Administration of any violations of the use of the web resource or the information obtained from it.

4.7. The Administration has the right:

To use the personal data of Users within the limits described in the Privacy and Personal Data Protection Policy. 

To terminate the operation of the Site at any time in the absence of obligations to Users, which are posted on an advertising basis.

To use the User's contact information to provide them with additional services.

5. Intellectual property rights

5.1. All components of the Site and the Site as a whole belong to the Site Owner and are protected by legislation in the field of intellectual property law.

5.2. The User confirms and agrees that all content and materials available on the Site are protected, including, but not limited to, copyright and trade secrets of the Site Owner. Reproduction, copying, or distribution for commercial purposes of any materials or elements of the Site without the prior permission of the Site Administration is strictly prohibited.

6. Disclaimer of warranties and limitation of liability

6.1. The User agrees that they use the Site at their own risk "as is", and the Site Owner, including management and employees, bears no responsibility for any damages or losses resulting from the use of the Site. 

6.2. The Site Administration does not guarantee that the operation of the Site will be uninterrupted, error-free, and free of harmful software or other defects.

7. Changes and agreements

7.1. The Site Administration has the right to make changes or additions to these Terms at any time without any special notice by posting the new version of the Terms on the Site. The new version of the Terms comes into effect from the moment it is posted on the Site unless otherwise provided by the new version of the Terms.

7.2. The Site Administration has the right to change the structure of the Site, its design and services without any special notice. 

7.3. The Administration disclaims responsibility for: direct and indirect damages to Users that arose as a result of a violation of the Law or the rights of third parties and were the reason for the imposition of penalties; any disputes between Users and third parties must be resolved without involving the Site Administration.
